It is now extremely common for Contractors to take on design (as well as build) responsibility on construction projects. Schemes are becoming more complex in terms of size and scope as modern construction methods advance. Accordingly, Contractors are focused on the risks associated with "D&C projects", which have historically caused many disputes, large losses and cost overruns. Contractors have a need to be able to adequately insure their design risk via D&C insurance. There are several D&C policy coverage issues that recur frequently and can create uncertainty about the level and scope of cover provided. This can create a cascade of challenges through the supply chain. In this session we will explore common D&C coverage issues and how better clarity might be achieved in the interests of all parties. Insurance is a vital component of a healthy construction sector and can provide solutions as the market evolves. However, insurance should perhaps be seen as one element of an overall risk management landscape. The session will also touch on the changing regulatory arena and the need for Contractors and insurers to adapt accordingly.
