Workshop: Still searching for Nirvana
Description

During this workshop Commercial Risk editorial director Adrian Ladbury will interview Praveen Sharma, Head of the Insurance Regulatory & Tax Consulting Practice at Marsh and Pim Moerman, Head of Insurance & Risk Management at Royal Philips about the world of global programmes and how best to structure and manage them to achieve consistency, clarity and compliance as much as possible. A core part of the discussion will focus on the FINC clause, how, where and when this should be used. Questions to be tackled include:

  • Are global programmes as valuable as they used to be in this uncertain world? Are they still worth the effort?
  • What are the main misconceptions in the insurance industry around global programmes, regulations and taxation? 
  • What are the main global programme structure options and has demand from risk managers changed in recent times? 
  • What are the main regulatory issues affecting global programmes? Do the regulations themselves change or is it more really about the approach of the insurers and their legal advisers to the regulations in areas such as non-admitted versus admitted and the use of DIC/DIL?
  • What about taxation Issues affecting global programmes – what are they and what do risk managers need to consider when building a programme? Who is responsible for making sure the correct payments are made in the right territories?
  • What is the latest on financial interest cover clauses – how to make sure they actually work as intended? Are insurers actually using the IUA model clause you helped to design and if not why not? How can we persuade the insurers to adopt a more consistent interpretation and reduce confusion and uncertainty?
  • How do you actually achieve Nirvana in the global programmes world? Has this become more or less likely in recent times and if so why/why not?
